Quy định mới về điều kiện về an ninh, trật tự đối với kinh doanh dịch vụ cầm đồ

New regulations on security and order conditions for pawnshop business

Ngày 24/7/2023, Chính phủ ban hành Nghị định 56/2023/NĐ-CP sửa đổi một số điều tại Nghị định 96/2016/NĐ-CP quy định điều kiện về an ninh, trật tự đối với một số ngành, nghề đầu tư kinh doanh có điều kiện. Theo đó, cơ sở kinh doanh dịch vụ cầm đồ phải đáp ứng điều kiện sau đây:

On July 24th, 2023, the Government promulgated Decree No. 56/2023/ND-CP amending a number of articles in Decree No. 96/2016/ND-CP stipulating security and order conditions for a number of conditional sectors of business and investment. Accordingly, a pawnshop must satisfy the following conditions:

Trong thời gian 05 năm liền kề trước thời điểm đăng ký kinh doanh, người chịu trách nhiệm về an ninh, trật tự của cơ sở kinh doanh dịch vụ cầm đồ không bị cơ quan chức năng xử phạt vi phạm hành chính về một trong các hành vi:

During the period of 05 consecutive years before the time of business registration, the person responsible for the pawnshop’s security and order shall not be sanctioned for an administrative violation by the competent authority regarding one of the following behaviors:

– Chống người thi hành công vụ;

Any actions against people on duty;

– Gây rối trật tự công cộng;

Disturbing public order;

– Cố ý gây thương tích;

Deliberately inflicting injury;

– Cho vay lãi nặng;

Usury;

– Đánh bạc;

Gambling;

– Tổ chức đánh bạc hoặc gá bạc;

Organizing gambling;

– Trộm cắp tài sản;

Robbing or stealing property;

– Lừa đảo chiếm đoạt tài sản;

Fraudulent appropriation of property;

– Chiếm giữ trái phép tài sản.

Unauthorized possession of property.

So với quy định hiện hành, quy định mới không còn yêu cầu người chịu trách nhiệm về an ninh, trật tự của cơ sở kinh doanh dịch vụ cầm đồ phải là người có hộ khẩu thường trú ít nhất 05 năm tại xã, phường, thị trấn nơi đăng ký đặt địa điểm hoạt động kinh doanh.

Compared with the current regulations, the new regulations no longer require the person responsible for the pawnshop’s security and order to have a permanent residence for at least 5 years in the commune, the ward, the town where the registered place of business is located.

Nghị định này sẽ có hiệu lực từ ngày 15/08/2023.

This Decree shall take effect from August 15th, 2023.
