Cho phép cấp giấy phép lao động bản điện tử cho người lao động nước ngoài
Allow electronic work permits to be issued to foreign workers
Ngày 18/9/2023, Chính phủ đã ban hành Nghị định 70/2023/NĐ-CP sửa đổi Nghị định 152/2020/NĐ-CP quy định về người lao động nước ngoài làm việc tại Việt nam và tuyển dụng, quản lý người lao động Việt nam làm việc cho tổ chức, cá nhân nước ngoài tại Việt Nam.
On September 18th, 2023, the Government promulgated Decree No 70/2023/ND-CP amending Decree No 152/2020/ND-CP regulating foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign employers in Vietnam.
Theo đó, Bộ Lao động – Thương binh và Xã hội hoặc Sở Lao động – Thương binh và Xã hội nơi người lao động nước ngoài dự kiến làm việc có thẩm quyền cấp giấy phép lao động cho người lao động nước ngoài theo Mẫu số 12/PLI Phụ lục I ban hành kèm Nghị định.
Accordingly, the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs where the foreign worker is expected to work has the authority to issue work permits to foreign workers according to Form No. 12. /PLI Appendix I issued with the Decree.
Bên cạnh giấy phép lao động là bản giấy theo mẫu như hiện nay, Nghị định còn cho phép cấp giấy phép lao động là bản điện tử nhưng phải đảm bảo phù hợp với quy định của pháp luật liên quan và đáp ứng nội dung theo Mẫu số 12/PLI quy định về Mẫu giấy phép lao động.
In addition to the current hard copy of the work permit form, the Decree also allows the issuance of electronic work permits. Still, it must ensure compliance with relevant legal regulations and meet the content according to Form: no. 12/PLI regulations on work permit forms.
