1. Đề xuất giảm thuế giá trị gia tăng (GTGT) từ 10% xuống 8% cho toàn bộ hàng hóa, dịch vụ đến hết năm 2023

Proposing to decrease value added tax (VAT) from 10% to 8% for all goods and services until the end of 2023

Bộ Tài chính đang lấy ý kiến về dự thảo Nghị quyết của Quốc hội về giảm thuế GTGT đối với toàn bộ hàng hóa, dịch vụ chịu thuế GTGT 10% được giảm xuống 8% đến hết năm 2023.

The Ministry of Finance is collecting comments on the draft of the Resolution of the National Assembly on decreasing the VAT for all goods and services which are subject to 10% tax rate down to 8% until the end of 2023.

Theo đó, cơ sở kinh doanh được áp dụng mức thuế suất thuế GTGT 8% đối với hàng hóa, dịch vụ đang áp dụng mức thuế suất 10%.

Accordingly, business premises are allowed to apply the VAT of 8% to all the goods and services that are subject to 10% tax rate.

Việc giảm thuế GTGT cho từng loại hàng hóa, dịch vụ đang áp dụng mức thuế suất 10% được áp dụng thống nhất tại các khâu nhập khẩu, sản xuất, gia công, kinh doanh thương mại.

The decrease in VAT for each type of goods and services are subject to the VAT of 10% is uniformly applied in import, produce, manufacturing and commercial business.

Ngoài ra, cơ sở kinh doanh (bao gồm cả hộ kinh doanh, cá nhân kinh doanh) tính thuế GTGT theo phương pháp tỷ lệ % trên doanh thu được giảm 20% mức tỷ lệ % để tính thuế GTGT khi thực hiện xuất hóa đơn đối với hàng hóa, dịch vụ được giảm thuế GTGT.

In addition, business premises (including business households and individuals) calculating VAT by the percentage method on revenue receive a reduction of 20% of the percentage rate for VAT calculation when issuing invoices for goods and services with VAT reduced.

Dự kiến thời gian áp dụng là từ khi chính sách này được ban hành cho đến hết 31/12/2023.

The estimated application period is upon the issuance of this policy until the end of December 31^st, 2023.

 

2. Dịch vụ tiếp thị, giới thiệu sản phẩm quảng cáo chỉ được sử dụng dữ liệu cá nhân của khách hàng khi khách hàng đồng ý

Use of customers’ personal data in marketing and product advertisement services are only permitted with customers’ approval

Ngày 17/4/2023, Chính phủ đã ban hành Nghị định 13/2023/NĐ-CP về bảo vệ dữ liệu cá nhân.

On April 17^th, 2023, the Government has issued Decree No. 13/2023/NĐ-CP on protecting personal data.

Theo Nghị định, tổ chức, cá nhân kinh doanh dịch vụ tiếp thị, giới thiệu sản phẩm quảng cáo chỉ được sử dụng dữ liệu cá nhân của khách hàng được thu thập qua hoạt động kinh doanh của mình để kinh doanh dịch vụ tiếp thị, giới thiệu sản phẩm quảng cáo khi có sự đồng ý của chủ thể dữ liệu.

According to the Decree, organizations and individuals providing marketing and product advertisement services can only use customers’ personal data collected through their business activities to conduct marketing and product advertisement services with the customers’ consent.

Việc xử lý dữ liệu cá nhân của khách hàng để kinh doanh dịch vụ tiếp thị, giới thiệu sản phẩm quảng cáo phải được sự đồng ý của khách hàng, trên cơ sở khách hàng biết rõ nội dung, phương thức, hình thức, tần suất giới thiệu sản phẩm.

The processing of customers’ personal data to conduct marketing and product advertisement services must be approved by the customers, on the basis that the customers are fully aware of the content, the method, the form and the frequency of product introduction.

Tổ chức, cá nhân kinh doanh dịch vụ tiếp thị, giới thiệu sản phẩm quảng cáo có trách nhiệm chứng minh việc sử dụng dữ liệu cá nhân của khách hàng được giới thiệu sản phẩm đúng với quy định trên.

Organizations and individuals providing marketing and product advertisement services have the responsibility to demonstrate the use of personal data of the customer to whom the products are introduced to in accordance with the above provisions.

Nghị định này có hiệu lực thi hành từ ngày 01/7/2023.

This Decree shall take effect from July 1^st, 2023.
