TRADEMARK RENEWAL
1. What is trademark renewal?
Renewal of validity of protection titles is a compulsory procedure. According to Intellectual Property Regulations, the validity of a trademark is 10 years from the filing date. Therefore, after that period of time, the owner has to renew the validity of protection titles to continue using the trademark.
2. Why do you have to renew your trademark?
According to Vietnam Regulations, to remain the validity of protection titles and continue to use the trademark exclusively, the trademark’s owner needs to proceed renewing Trademark Registration Certificate before expiring date.
3. Term of renewing validity of protection titles:
In order to get the validity of protection titles renewed, the owner of the certificate shall file a request for renewal of protection title’s validity to Intellectual Property Office of Vietnam (IPVN) within 06 months prior to invalid protection titles.
The request for renewal of protection title’s validity is able to be later than the term above but not exceeding 06 months since the expiration of the validity term and the protection title holder shall pay the delayed renewal fee for each month of delayed payment.
Note: The validity of a trademark protection title is 10 years from the filing date, NOT the date of granting the protection title.
4. Essential documents for trademark renewal:
Trademark renewal dossier includes these following documents:
– Declarations requesting renewal of protection titles’ validity
– Original protection title (Reissue fee shall arise in the event of losing the protection title)
– Notarized copies of Business Registration Certificate.
Number of dossiers: 2 copies.
5. Trademark renewal process:
– IPVN examines the request for validity renewal within 01 month from the receiving date. In case of no shortcomings, IPVN shall issue a decision on renewal of protection titles, record into protection titles, register and public it in the Intellectual Property Official Gazette. However, due to the actual increasing number of trademark applications, renewal period is often longer than regulations, which lasts from 01 to 04 months.
– IPVN issues an intending notice on renewal rejection that pointing out reasons and assigning one-month period from the date of sending out for petitioner to revise or have objection opinions, if the request for validity renewal is one of these circumstances bellowed:
- The request for validity renewal is improper or is filed inappropriately as regulated procedure.
- The petition is not the protection title holder correspondingly.
- Within the assigned period, if the petition does not correct or fails to correct all the mistakes, or has no objection or objects inaccurately, IPVN shall issue a notice of renewal rejection.Valued Clients are interested in our Renewal Trademark Service, please contact us via:
