Registration of copyright or related rights in Viet Nam

What is copyright?

Copyright means rights of organizations and individuals to works they have created or own. 

Types of works covered by copyright:

Literary, artistic and scientific works covered by copyright include:

a) Literary and scientific works, textbooks, teaching courses and other works expressed in written languages or other characters;

b)  Lectures, addresses and other sermons;

c) Press works;

d) Musical works; 

đ) Dramatic works;

e) Cinematographic works and works created by a process analogous to cinematography (hereinafter referred to collectively as cinematographic works);  

g) Plastic-art works and works of applied art;

h) Photographic works;

i/ Architectural works;

k/ Sketches, plans, maps and drawings related to topography or scientific works; 

l/ Folklore and folk art works of folk culture;

m)  Computer programs and compilations of data.

What is copyright-related right?

Copyright-related rights (hereinafter referred to as related rights) mean rights of organizations and individuals to performances, phonograms, video recordings, broadcasts and encrypted programs carrying satellite signals.

Related rights are rights of organizations and individuals to performances, phonograms, video recordings, broadcasts and encrypted program carrying satellite signals. Rights of performers shall have the term of protection of fifty years counting from the year following the year of fixation of performances. The rights of producers of phonograms or video recordings shall be protected for fifty years counting from the year following the year of fixation of unpublished phonograms or video recordings. The rights of broadcasting organizations shall be protected for fifty years counting from the year following the year of the making of their broadcasts.

Rights of performers are recognized and protected by almost all national laws, including Vietnam Intellectual Property Law. However, in Vietnam not only because of the complex property of this right, but also the limited awareness of the relevant stakeholders, the protection of the rights of performers faces many difficulties.

REGISTRATION OF COPYRIGHT AND RELATED RIGHTS
