INDUSTRIAL DESIGNS REGISTRATION IN VIETNAM
What are the Industrial Designs (KDCN)?Industrial designs are the appearance of a product and refers to the product’s overall function. Industrial designs are a very important sign for consumers to choose products.
Why must you register for protection of industrial designs?
• Design of a product is the factor that attracts or attracts customers. This is the main factor in deciding to choose a product. Precisely because of the commercial importance of an industrial design to its success, protecting it from the competitor’s copy and imitation becomes an important part of business strategy of businesses.
• Industrial designs play an important role in the successful marketing of a wide range of products, helping to define the brand image of the business. Industrial designs protection guarantees monopoly over their use and is a key element in the marketing strategy.
• A protected industrial design can generate an additional source of income for a company through the collection of fees for the licensing of the industrial design to another person or through the sale of the rights of a registered industrial design.
Procedures for registration of industrial designs:
To register industrial designs, Enterprises need to provide us with the following information:
• Industrial design photos / drawings;
• Description of industrial design;
• Business information (Scanned copy / photocopy of business registration license)
Time and process of industrial design registration:
• Time for preliminary search, appraisal and assessment of the ability of industrial design to protect as follows: 1 working day
• Time for dossier preparation and completion of registration procedures: 5 working days.
• After submitting the application, an industrial design registration application will go through the following stages:
+ Examination of the form of an industrial design registration application: 01 months from the filing date;
+ Publication of industrial design registration applications: 2 months from the date the application is accepted as valid in form;
+ Content test: 10 – 12 months from the date of publication of the industrial design registration application.
If the content test results show that the applicant’s industrial design is capable of protection, the Vietnam National Office of Intellectual Property will issue a protection title within 2 months thereafter.
Term of protection: Patents Industrial designs have a term of protection of 05 years from the date of filing of the registration application. Upon the expiration of this protection period, the enterprise can apply for an extension of the protection period for 2 more times, each 5 years. Thus, the total term of protection for an industrial design Patent is no more than 15 years.
