1. Hướng dẫn mới về đối tượng không thuộc phạm vi bảo hộ quyền tác giả

New guidance on objects not covered by copyright protection

Ngày 26/4/2023, Chính phủ đã ban hành Nghị định 17/2023/NĐ-CP quy định chi tiết một số điều và biện pháp thi hành Luật Sở hữu trí tuệ về quyền tác giả, quyền liên quan. Theo đó, các đối tượng không thuộc phạm vi bảo hộ quyền tác giả bao gồm:

On April 26th, 2023, the Government promulgated Decree 17/2023/ND-CP detailing a number of articles and measures to implement the Intellectual Property Law on copyright and related rights. Accordingly, objects not covered by copyright protection consist of:

– Tin tức thời sự thuần túy đưa tin là các thông tin báo chí ngắn hàng ngày, tin vặt, số liệu sự thật, chỉ mang tính chất đưa tin, không có tính sáng tạo.

Pure news reports which are daily short press information, breaking news and data of facts for coverage purposes only, not for creativity.

– Văn bản hành chính bao gồm văn bản của cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị – xã hội, tổ chức chính trị xã hội – nghề nghiệp, tổ chức xã hội, tổ chức xã hội – nghề nghiệp và đơn vị lực lượng vũ trang nhân dân.

Administrative documents including documents of state agencies, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations and units of the people’s armed forces.

– Quy trình, hệ thống, phương pháp hoạt động, khái niệm, nguyên lý, số liệu được hiểu như sau:

Processes, systems, operation methods, concepts, principles and data are explained as follows:

+ Quy trình là trình tự phải tuân theo để tiến hành công việc

Process is an order to follow so as to do the job

+ Hệ thống là tập hợp nhiều yếu tố, đơn vị cùng loại hoặc cùng chức năng, có quan hệ hoặc liên hệ với nhau chặt chẽ, làm thành một thể thống nhất

System is a collection of many elements and units of the same type or function, related or closely related to each other, forming a unified whole

+ Phương pháp là cách thức nghiên cứu, nhìn nhận các hiện tượng của tự nhiên và đời sống xã hội

Method is a way of studying and seeing the phenomena of nature and social life

+ Khái niệm là ý nghĩ phản ánh ở dạng khái quát các sự vật và hiện tượng của hiện thực và những mối liên hệ giữa chúng

Concept is a thought that reflects in a general form the things and phenomena of reality and the relationships between them

+ Nguyên lý là định luật cơ bản có tính chất tổng quát, chi phối một loạt hiện tượng, là những ý tưởng hoặc lý thuyết ban đầu quan trọng và được coi là xuất phát điểm cho việc xây dựng những lý thuyết khác.

Principles are fundamental laws of general nature, governing a wide range of phenomena, are the first important ideas or theories, and are considered as starting points for the construction of other theories

Nghị định này đã có hiệu lực từ ngày 26/4/2023.

This Decree took effect from April 26th, 2023.

2. Không được dùng hình ảnh bác sĩ để quảng cáo bán hàng đa cấp

Use of doctor images to advertise multi-level sales is prohibited

Ngày 28/4/2023, Chính phủ ban hành Nghị định 18/2023/NĐ-CP sửa đổi Nghị định 40/2018/NĐ-CP về quản lý hoạt động kinh doanh theo phương thức đa cấp.

On April 28th, 2023, the Government promulgated Decree 18/2023/ND-CP amending the Decree 40/2018/ND-CP on management of business activities by multi-level method

Trong đó, bổ sung quy định về trách nhiệm của doanh nghiệp và người tham gia bán hàng đa cấp như sau:

Accordingly, regulations on the responsibilities of enterprises and participants in multi-level sales are supplemented with details as follows:

Không cung cấp thông tin về thực phẩm bằng hình thức sử dụng hình ảnh, thiết bị, trang phục, tên, thư tín của các đơn vị, cơ sở y tế, bác sỹ, dược sỹ, nhân viên y tế, thư cảm ơn, lời cảm ơn của người bệnh, bài viết của bác sỹ, dược sỹ, nhân viên y tế; không cung cấp thông tin về thực phẩm có nội dung đăng tải, dẫn, trích dẫn hoặc nêu ý kiến người bệnh mô tả thực phẩm có tác dụng điều trị bệnh.

Provision of information about food by using images, equipment, costumes, names, correspondences of health facilities and units, doctors, pharmacists, health workers, testimonials of patients, articles written by doctors, pharmacists, health workers, as well as provision of information about food representing or quotations of patients’ opinions saying that the food has therapeutic effects are not allowed.

Nghị định này có hiệu lực thi hành từ ngày 20/6/2023.

This Decree shall come into effect from June 20th, 2023.
